AHA! I wrote earlier about the difference between what constitutes public domain works, and the works in public domain which are protected by the Copyrights. When these LLM training companies started misleading the public in general that the works they are using are being considered under the ambit of public domain works, I vehemently opposed this concept in my earlier blogs, and wrote and distinguished further the difference between public domain, and, the works available in the public domain; as after all, copyrighted works are also available in the public domain too, which many of the companies wanted to prove as public domain works. Notice the difference!
Indeed, just alike the English alphabets, and, grammar, which are available in the public domain, but the poetic rhymes derived from them are protected by the copyrights which are the works available in the public domain under the definition of PUBLISHED WORKS! And then, there are works, which are protected as UNPUBLISHED WORKS, which are not available in the public domain. Understood?Similarly, the compositions of DAGAR Brothers, were TRANSFORMED Works, that albeit used the public domain works, but, to create work protected by the Copyrights, which are available, published in the public domain, again protected; UNLIKE, unprotected public domain works which most of the people contend to mix with the protected works.
And those who’re contending an analogy giving example of Ghibli ART, then that I’ve also explained & covered in my earlier preceding blog.
What YouTube did initially was also wrong, as it monetized plagiarized Works & distributed billions of dollars. Would Google / YouTube OPEN ITS OWN IP for everyone to use? NAH! Rather they would sue others for criminality! And I wrote to them also, what they were doing was not appropriate, and shared the screenshot of that mail in my earlier blogs. Never Mind!
But I’m happy that now the derivative, inspired, adaptations, non-transformative works are being openly considered as infringed works, no matter, what you’re or how big legal eagles you hire! 😊
